Article 2 — Scope of Application
These General Terms and Conditions of Sale (hereinafter "GTC") govern, without restriction or reservation, all sales concluded remotely, via the website accessible at lirnova.com, between Lirnova and any non-professional consumer acting for purposes that do not fall within the scope of their commercial, industrial, craft, liberal, or agricultural activity (hereinafter "the Customer").
Any order placed on the website implies the Customer's unreserved acceptance of these GTC, in their version in force on the day of the order.
Article 3 — Essential Characteristics of Products
The products offered are those appearing on the website on the day of consultation, within the limits of available stock. Each product sheet specifies the essential characteristics of the item: composition, dimensions or sizes, patterns, price, any usage warnings. The photographs presented are indicative and cannot engage the seller's responsibility in the event of slight differences perceptible on screen.
Article 4 — Price
Prices are indicated in euros, all taxes included (TTC). They are applicable on the day of the order. Any delivery costs are indicated separately during the cart validation process, before payment.
Lirnova reserves the right to modify its prices at any time; products are invoiced at the rate in force at the time of order validation.
Article 5 — Ordering Process
The Customer selects the desired products, size, and pattern, then adds them to their cart. They then check the contents of their cart, enter their contact details, choose a delivery method and a payment method.
Before definitively validating their order, the Customer is invited to check all the entered information and to tick the box accepting these GTC. The order is only definitively registered after this validation, which constitutes acknowledgment of having read and accepted the GTC.
Article 6 — Order Confirmation
A confirmation email, serving as an acknowledgment of receipt, is sent to the Customer at the indicated address. This email summarizes the essential characteristics of the ordered item, the total price, the payment and delivery terms, and the existence of the legal right of withdrawal.
Article 7 — Payment
Payment is due upon order. Accepted payment methods are indicated on the website (Visa, Mastercard, Apple Pay, PayPal, Klarna cards, subject to availability).
The banking data transmitted during payment are encrypted in accordance with market standards; they are not stored by Lirnova but processed by the payment providers mentioned in the Privacy Policy.
Article 8 — Availability — Preparation and Shipping
Products are offered within the limits of available stock. When the product sheet indicates "In stock", the order is prepared and shipped within an indicative period of 3 business days from the validation of payment.
In case of total or partial unavailability noted after ordering, Lirnova will inform the Customer as soon as possible and will, if necessary, refund the corresponding amounts.
Article 9 — Delivery
Deliveries are carried out by a professional carrier to the address indicated by the Customer. The delivery time depends on the chosen carrier and the destination.
Delivery is free for any order equal to or greater than €50. Any shipping costs due below this threshold are indicated before payment validation.
Details of delivery terms (preparation, shipping, tracking, delayed/lost/damaged package, incorrect address) are provided in the Delivery Policy.
Article 10 — Transfer of Risks
In accordance with Article L. 216-4 of the French Consumer Code, any risk of loss or damage to the goods is transferred to the Customer at the moment they, or a third party designated by them, other than the carrier proposed by the seller, physically takes possession of these goods.
Article 11 — Address and Information Provided by the Customer
It is the Customer's responsibility to provide accurate and complete information when ordering. An incorrect, incomplete, or non-existent address may result in a delay, return, or non-delivery. Any re-shipping costs resulting from an error attributable to the Customer may be charged to the latter.
Article 12 — Right of Withdrawal
The Customer has a period of fourteen (14) days from receipt of the goods to exercise their right of withdrawal, without having to give reasons for their decision, in accordance with Articles L. 221-18 et seq. of the French Consumer Code.
The terms of exercise and the standard form are detailed on the Right of Withdrawal page. Return shipping costs are borne by the Customer, unless otherwise indicated.
Legal Exceptions. In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply in particular to goods which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly, nor to sealed goods which cannot be returned for health protection or hygiene reasons and which have been unsealed by the Customer after delivery.
Article 13 — Returns and Refunds
The terms of return and refund are detailed in the Returns and Refunds Policy. Refunds of sums paid are made no later than fourteen (14) days following the date on which Lirnova was informed of the Customer's decision to withdraw, subject to the recovery of the goods or proof of shipment, the earliest of these events being taken as the effective date.
Article 14 — Legal Guarantee of Conformity
The products sold benefit automatically and without additional cost from the legal guarantee of conformity provided for in Articles L. 217-3 et seq. of the French Consumer Code, which authorizes the Customer to obtain the conformity of the goods, their repair or replacement within two years from their delivery. For goods sold, this guarantee is exercised without the Customer having to prove the existence of the defect for twenty-four (24) months following delivery.
Article 15 — Guarantee against Hidden Defects
The Customer also benefits from the guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code, allowing them, in the event of a hidden defect making the goods unfit for their intended use, to choose between cancellation of the sale or a reduction in price. The action must be brought within two years of discovery of the defect.
Article 16 — Defective or Non-Conforming Products
In the event of a defective, damaged, or non-conforming product being delivered, the Customer is invited to contact Lirnova as soon as possible via the Contact page, attaching photographs if possible. A solution (replacement, repair, or refund) will be offered within the framework of the legal guarantees mentioned above.
Article 17 — Liability
Lirnova's liability is limited to foreseeable direct damages resulting from the non-compliance with its contractual obligations, excluding any indirect damage. No provision of these GTC restricts the mandatory rights granted to consumers by the French Consumer Code.
Article 18 — Force Majeure
Lirnova cannot be held responsible for the non-performance or delay in the performance of an obligation resulting from a case of force majeure as defined in Article 1218 of the French Civil Code.
Article 19 — Personal Data
The processing of Customers' personal data within the framework of orders is described in the Privacy Policy.
Article 20 — Intellectual Property
All elements of the website remain the exclusive property of Lirnova or its partners. No transfer of ownership occurs as a result of an order.
Article 21 — Complaints
Any complaint can be submitted via the Contact page. Lirnova endeavors to provide a response within a reasonable timeframe.
Article 22 — Consumer Mediation
In accordance with Articles L. 611-1 et seq. of the French Consumer Code, every consumer has the right to free recourse to a consumer mediator for the amicable resolution of a dispute with a professional. The contact details of the competent consumer mediator will be communicated upon effective adherence: [TO BE COMPLETED AFTER EFFECTIVE ADHERENCE TO A REFERENCED MEDIATOR].
The consumer can also use the European online dispute resolution (ODR) platform at: https://ec.europa.eu/consumers/odr.
Article 23 — Applicable Law and Competent Courts
These GTC are subject to French law. In the event of a dispute, and after an attempt at amicable resolution, the French courts will have jurisdiction, under the conditions provided for by the French Code of Civil Procedure.
